Barlow v. Miller




Part 1

Case exhibiting the will of Richard Miller of Manchester druggist deceased promoted  by Margaret Barlow (formerly Miller) daughter and legatee against John Miller son and the surviving executor. Margaret challenges the capability of the testator at the time of giving instructions of the will. Richard left the real estate to John after paying legacies to the widow, Margaret and her sister. She claims that the amount of her legacy should read 'ten pounds' instead of 'six pounds' as it now appears in the will. It is seen that the word 'six' was overwritten on some other word. Three attorney clerks who wrote the will out of the original instructions were invited as witnesses but they could not give clear recollection whether the word 'six' was overwritten by mistake during the draft writing.
