Atherton v. Fotheringham

Part 1

Atherton v. Fotheringham

Case brought by James Atherton of Liverpool grocer against John Gorden Foderingham and William Foderingham. The Foderinghams carried a quantity of sugar which was sold by public auction in Liverpool in November 1805 to James Atherton. Atherton claims that he was not given a fair sample of the quality of the sugar and refuses to pay for it. The Foderinghams have brought an action at the Court of Kings Bench against Atherton and he has brought this case to stop it.
